1. Overview & Acceptance
These Terms & Conditions ("Terms") govern your use of Nostalgix LLC ("Nostalgix") services, including our website, client portal, and brokerage services. By engaging with Nostalgix — including by listing an item, submitting an inquiry, signing in to the client portal, or buying, selling, or otherwise transacting through Nostalgix — you agree to be bound by these Terms, including the brokerage terms set out below. These Terms apply whether or not you have separately signed a written Brokerage Agreement.
2. Services
Nostalgix operates as a private collectibles brokerage, facilitating transactions between buyers and sellers of high-end collectibles including comics, trading cards, art, and memorabilia. Our services include:
- Private listing and matching of collectible items.
- Brokered introductions between qualified buyers and sellers.
- Escrow services for secure transaction settlement.
- Insured vault storage for high-value items.
- Buyer and seller anonymity throughout the transaction process.
3. Eligibility
Nostalgix services are available to individuals and entities dealing in collectibles with a minimum item value of $20,000. We reserve the right to decline service at our discretion. All clients must provide accurate identity and contact information during onboarding.
4. Commission & Fees
A standard seller's fee of 10% of the total sale value applies to completed transactions, unless otherwise negotiated in writing. This fee is deducted from the sale proceeds payable to the seller and is earned upon the successful close of a deal. There is no fee to buyers. Additional fees may apply for vault storage, insurance, and specialized authentication services; all such fees will be disclosed and agreed upon before those services are rendered.
5. Brokerage Agreement & Precedence
By transacting through Nostalgix you accept these Terms, including the brokerage terms set out herein, and these Terms govern the brokerage relationship whether or not you have signed a separate written agreement. Clients may also be asked to sign a written Brokerage Agreement covering specific terms of engagement, such as commission rates, exclusivity periods, and service scope. Where a client has signed a Brokerage Agreement, that signed agreement governs and controls in the event of any conflict, and these Terms supplement it. Where no Brokerage Agreement has been signed, these Terms alone govern the relationship.
6. Listings & Representations
Sellers are responsible for the accuracy of listing information, including item descriptions, grading, provenance, and condition. Each client represents that they have full legal ownership of any item they submit, that the item is free of liens or encumbrances, and that all descriptions they provide are accurate to the best of their knowledge. Nostalgix may verify claims through third-party grading services but does not guarantee the accuracy of seller representations.
7. Escrow & Settlement
All transactions are conducted through our escrow service to protect both parties. Funds are held in escrow until item delivery and inspection are confirmed. Nostalgix is not a party to the sale — we act as a facilitator and fiduciary intermediary. Dispute resolution procedures are outlined in the brokerage agreement.
8. Shipping Requirements
All domestic shipments must be sent via overnight service with signature confirmation. International shipments must be sent via priority service with signature confirmation. Clients assume responsibility for proper packaging and insurance of items in transit unless otherwise agreed in writing.
9. Final Sale
All transactions are final. Once an item has been delivered to the buyer and funds have been disbursed to the seller — following any inspection period provided through escrow — no returns, refunds, or reversals are permitted for any reason.
10. Confidentiality & Non-Disclosure
All client information, transaction details, and communications are treated as strictly confidential under Nostalgix's blanket non-disclosure agreement, which applies to every client and transaction by default. Clients agree not to disclose the identity of counterparties, deal terms, or proprietary Nostalgix processes to third parties without written consent.
Nostalgix will not publicly disclose or market the details or results of any transaction without the written consent of both the buyer and the seller.
11. Client Portal
Access to the Nostalgix client portal is provided on an invitation basis. By signing in to or continuing to use the client portal, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. You are responsible for maintaining the security of your login credentials. Portal access may be revoked at our discretion. The portal is provided "as is" and we do not guarantee uninterrupted availability.
12. Limitation of Liability
Nostalgix acts as an intermediary and does not take ownership of items or guarantee the completion of any transaction. Nostalgix shall not be liable for any indirect, incidental, or consequential damages arising from its services, including items lost or damaged in transit. We are not liable for losses arising from item condition disputes, market value fluctuations, or counterparty default. Except for amounts recoverable under insurance arranged for items held in Nostalgix's vault storage, our total liability shall not exceed the fees paid to Nostalgix on the relevant transaction.
13. Intellectual Property
All content on the Nostalgix website and portal, including text, graphics, logos, and software, is the property of Nostalgix and protected by applicable intellectual property laws. Client-uploaded media remains the property of the client but is licensed to Nostalgix for use in facilitating transactions.
14. Termination
Either party may terminate the client relationship at any time with written notice. Termination does not affect obligations arising from pending or completed transactions. Commission obligations survive termination for deals initiated during the engagement period.
15. Governing Law
These Terms are governed by the laws of the State of Washington. Any disputes arising from these Terms or our services shall be resolved through binding arbitration, unless otherwise specified in a brokerage agreement.
16. Changes to Terms
We may update these Terms from time to time. Clients will be notified of material changes through the client portal or via email. Continued use of our services after changes constitutes acceptance of the updated Terms.
